EXECUTIVE SESSION In accordance with Texas Government Code, Chapter 551, Subchapter D, the City Council will now recess into Executive Session (closed meeting) to discuss the following: A §551.071: CONSULTATION WITH ATTORNEY; on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act: to receive legal advice regarding the matter of the North Texas Municipal Water District (“NTMWD”) cost of service proceedings currently pending before the Public Utility Commission of Texas in PUC Docket No. 46662 7. RECONVENE INTO REGULAR SESSION The City Council will reconvene into Regular Session, pursuant to the provisions of Chapter 551, Subchapter D, Texas Government Code, to take any action necessary regarding: A. §551.071: CONSULTATION WITH ATTORNEY; on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act: to receive legal advice regarding the matter of the North Texas Municipal Water District (“NTMWD”) cost of service proceedings currently pending before the Public Utility Commission of Texas in PUC Docket No. 46662
C. Consider and/or act on matters relating to the North Texas Municipal Water District (“NTMWD”) cost of service proceedings currently pending before the Public Utility Commission of Texas in PUC Docket No. 46662, to include: Resolution 20-R-951, Authorizing participation along with other Texas cities and other entities, on an intervention to the PUC Docket No. 46662 and SOAH Docket No. 473-17-4964, which relates to the cost of service determination on the wholesale water rates imposed by the North Texas Municipal Water District; Authorizing the City Manager to sign an Engagement Letter with the firm Jackson Walker to represent the City of Murphy in the PUC Rate Case Intervention, and: Authorizing the City Manager to sign an Allied Litigant, Common Interest, Joint Defense, Information Sharing, and Confidentiality Agreement, relating to the PUC Rate Case Intervention.
